• Renting or subleasing any or all allocated space.

• Negative editorial comments about any person or business.

• Any content or activity that the Bailliage des Etats-Unis determines is inappropriate and does not reflect its standards.
  
  THIS SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING A WARRANTY THAT THE APPLICANT'S WEBSITE WILL BE AVAILABLE TO THE PUBLIC ON AN UNINTERRUPTED, TIMELY OR ERROR-FREE BASIS. WE STRONGLY SUGGEST THAT LOCAL BAILLIAGES KEEP CURRENT COPIES OF THEIR WEBSITES.
  
  THE BAILLIAGE DES ETATS-UNIS AND ITS MEMBERS SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCE OR LEGAL THEORY WHATSOVER, FOR ANY LOSS OF BUSINESS, PROFITS OR GOODWILL, LOSS OF USE OR DATA, OR FOR ANY INDIRECT SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER, RESULTING FROM OR RELATING TO THE USE OR PROVISION OF WEBSITE HOSTING SERVICES UNDER THIS AGREEMENT.
  
  Applicant agrees to indemnify and hold harmless the Bailliage des Etats-Unis and its members, officers and affiliates from any claim or demand (including attorneys' fees) made by any third party due to or arising from Applicant's conduct or use of the service contemplated by this application, including without limitation any alleged violation of any third party's trademark, copyright, patent, trade secret or any other proprietary rights. The Bailliage des Etats-Unis reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to Applicant's indemnification, but doing so will not excuse Applicant's indemnity obligations.
  
  The Bailliage des Etats-Unis reserves the right to monitor websites created under this plan by Applicant, and the Bailliage des Etats-Unis may in its sole discretion remove and delete any of Applicant's website content, at any time, with or without cause.
  
  This Application is the entire agreement between the Bailliage des Etats-Unis and Applicant with respect to the subject matter herein and supersedes any previous proposals, both oral and written, or communications between the parties. The parties agree that the terms of this agreement shall be governed by the laws of the state of New York, without regard to conflict of laws.
